U.S. Court of Appeals Case No: 07-1375
District of Nebraska - Omaha
[PUBLISHED] [Wollman, Author, with Chief Judge Loken and
Shepherd, Circuit Judges]
Criminal Case - conviction. Sufficient evidence was presented to support
convictions for drug conspiracy and distribution; testimony and physical
evidence established guilt beyond reasonable doubt. District court did
not err in finding defendant subject to enhancements for having two prior
felony drug convictions because he did not raise reasonable doubt as to
whether he was same person convicted in prior convictions. District
court did not clearly err in applying two-level enhancement for using a
minor.
