U.S. Court of Appeals Case No: 07-1439
U.S. District Court for the Western District of Missouri - Kansas City
[PUBLISHED] [Loken, Author, with Murphy, Circuit Judge, and
Jarvey, District Judge]
Criminal case - criminal law. Extent and nature of voir dire inquiry
into a possible prejudice is left to the discretion of the trial judge,
and the district court did not abuse its discretion in limiting the number
of questions posed or in determining the procedures for questioning the voir
dire panel about possible prejudices against gang members; statements
the government introduced were not testimonial, and their admission did
not violate defendant's confrontation clause rights as construed in
Crawford v. Washington, 541 U.S. 36 (2004); evidence was sufficient to
support defendant's conviction for murdering a man to prevent him from
communicating with law enforcement regarding possible federal offenses.
