U.S. Court of Appeals Case No: 07-1454
U.S. District Court for the Eastern District of Missouri - Cape Girardeau
[PUBLISHED] [Benton, Author, with Riley and Colloton, Circuit Judges]
Criminal case - criminal law. Evidence showed Jackson did not have an
ownership interest in stereo/video equipment and clothing found in his
girlfriend's vehicle at the time of his arrest, and the court did not
err in granting judgment for the government on his claims for return of
those items; however, Jackson was entitled to return of the custom wheels
on the vehicle as the evidence showed he had purchased the wheels and had
neither given them to his girlfriend nor abandoned his interest in them;
because the rims have been lost or misplaced, the matter is remanded to
permit Jackson to assert an alternative claim for monetary damages.
