Criminal Case - withdraw guilty plea. District court did not abuse its
discretion in denying motion to withdraw guilty plea, as defendant failed
to show a fair and just reason for requesting the withdrawal. Waiver of
appeal rights in plea agreement does not foreclose consideration on
appeal of whether defendant was competent when pleading guilty.
District court properly conducted change of plea hearing under Rule 11
and did not err in finding defendant competent.
