U.S. Court of Appeals Case No: 07-1632
U.S. District Court for the Western District of Missouri - Springfield
[PUBLISHED] [Benton, Author, with Riley and Colloton, Circuit Judges]
Criminal case - criminal law. Search warrants for defendant's
warehouses were supported by probable cause; even if they were not, the
evidence seized was admissible under Leon's good-faith exception;
evidence was sufficient to prove that defendant was involved in
conspiracies to distribute pseudoephedrine, knowing it would be used to
manufacture methamphetamine, and to commit money laundering;
court's response to jury question about the elements of money laundering
was proper and correctly referred the jury back to the instructions;
instructions on interstate commerce and money laundering were not
plainly erroneous.
