Civil case - Federal Railway Safety Act. Congress's amendment to 49
U.S.C. Sec. 20106 which would allow these cases to proceed in state
court, was constitutional; the court vacates its prior opinion in the case,
Lundeen v. Canadian Pacific Railway, 447 F.3d 606 (8th Cir. 2006), and
remands the cases to the district court with directions to further remand
them to state court. Judge Beam, dissenting.
