U.S. Court of Appeals Case No: 07-1813
U.S. District Court for the District of Minnesota - Minneapolis
[PUBLISHED] [Wollman, Author, with Bright and Smith, Circuit Judges]
Civil case - Business torts. Plaintiff failed to state a claim for tortious
interference with contract as it could not show that defendant acted
without justification; plaintiff failed to establish a claim under Minnesota
law for either intentional or negligent misrepresentation as it failed to
show a relationship sufficient to create a duty, reliance on a
misrepresentation or harm; plaintiff did not possess a property interest in
the hardware and software at issue, and its claim for conversion must fail;
because plaintiff failed to establish underlying fraud, conversion or other
torts to support its conspiracy or unjust enrichment claims, the claims
must fail.
