U.S. Court of Appeals Case No: 07-1913
and No: 07-2031
U.S. District Court for the Western District of Missouri - Kansas City
[PUBLISHED] [Shepherd, Author, with Colloton, Circuit Judge, and
Erickson, District Judge]
Criminal case - criminal law and sentencing. Evidence was sufficient to
support defendant Brandon's conviction for conspiracy to distribute
drugs; no error under either Rule 404(b) or Rule 403 in admitting post-
arrest statement; district court took appropriate corrective action when a
police witness made a prejudicial reference to a possible homicide, and a
mistrial was not required; challenge to mandatory minimum life sentence
under 18 U.S.C. Sec. 841(b)(1)(A) rejected; district court failed to
perform the necessary sentencing calculations when it imposed sentence
on Count V for defendant Brandon, and that count is remanded for
resentencing on the existing record.
