Civil case - RICO. Because the plaintiffs failed to establish that the
defendant bank directed the operations or management of the insolvent
commercial cattle company during the time the plaintiffs were allegedly
injured by the bank's pattern of racketeering activity, the district court
erred in denying the bank's motion for judgment as a matter of law
dismissing the RICO claims; the judgments for certain of the plaintiffs on
their tort claims for fraudulent misrepresentation, fraudulent concealment
and negligent misrepresentation are affirmed, while other portions of the
judgment are reversed; see the court's opinion for details regarding the
individual plaintiffs' claims; admission of limited settlement evidence
was not a clear and prejudicial abuse of discretion.
