Criminal case - criminal law. Indictment charging defendant with using
the peer-to-peer program Kazaa to distribute child pornography stated an
offense under 18 U.S.C. Sec. 2251(d)(1)(A), and the district court did not
err in denying defendant's motion to dismiss for failure to state an
offense; in the context of the Kazaa program, placing a file in a shared
folder with descriptive text is clearly an offer to distribute the file.
