Civil case - insurance. The district court did not err in directing a
verdict for plaintiff on defendant's material misrepresentation defense as
the statements upon which the defense relied were either not material
misrepresentations or were not made intentionally; court's statement to
the jury that it had directed a verdict on the material misrepresentation
affirmative defense did not prejudice the jury's consideration of the
defendant's arson defense.
