U.S. Court of Appeals Case No: 07-2085
U.S. District Court for the District of South Dakota
[PUBLISHED] [Smith, Author, with Wollman, Circuit Judge, and
Gritzner, District Judge]
Criminal case - Criminal law. In a prosecution for abusive sexual
contact with minors, evidence of a prior rape was properly admitted
under Rule 413, as it was relevant and its probative value outweighed
any unfair prejudice; fact that the incident occurred more than 11
years before the incident in question does not prevent admission of
the evidence as Congress has expressly rejected any time limit on prior
sex offense evidence; district court did not err in denying motion for
new trial based on a claim the victim's parents coached her testimony;
evidence was sufficient to support convictions.
