U.S. Court of Appeals Case No: 07-2093
U.S. District Court for the District of Minnesota - St. Paul
[PUBLISHED] [Erickson, Author, with Colloton and Shepherd, Circuit Judges]
Criminal case - Sentencing Guidelines. District court properly
calculated defendant's offense level and criminal history, consistent with
the Guidelines and United States v. Davis, 360 F.3d 901 (8th Cir. 2004);
district court did not abuse its discretion in departing above the advisory
range based on its conclusion that defendant was a repeat offender who
posed a high risk of recidivism and showed an unwillingness or inability
to obey the conditions of his probation or parole.
