Civil case - civil rights. See Amrine v. Bowersox, 128F.3d 1222 (8th
Cir. 1997) (en banc) for this court's opinion finding Amrine was entitled
to habeas relief on the ground that he had established his actual innocence
on charges that he murdered a fellow inmate; District court did not err in
finding prison investigator and deputy sheriff were entitled qualified
immunity on plaintiff's Section 1983 claims in connection with their
efforts to investigate the murder; the investigators' actions in detaining
Amrine were supported by probable cause; amendment of the complaint
to add a claim for reckless investigation would have been futile under this
court's precedents, and the district court did not err in denying Amrine's
request for leave to file a third amended complaint.
