U.S. Court of Appeals Case No: 07-2148
U.S. District Court for the Southern District of Iowa - Davenport
[PUBLISHED] [Smith, Author, with Wollman and Bright, Circuit Judges]
Civil case - Social Security. While an ALJ cannot based his decision
solely on his observations, the ALJ did not err in including his own
observations as one of the several factors he considered; the court could
not determine from the Appeals Council's decision whether it had
considered an undated letter from the claimant's treating physician, and
the matter is remanded for further proceedings.
