Criminal case - criminal law. The initial police contact with defendant
was not a seizure, and his voluntary statement that he was driving without
a license gave officers probable cause to arrest him; defendant abandoned
the weapon the officers seized and it was properly admitted; district court
did not abuse its discretion in dismissing charges without prejudice for
Speedy Trial Act violation, as it properly weighed all of the relevant
factors; district court did not err in holding trial on the same day the
government re-indicted defendant as it had notified defendant that if it
granted his Speedy Trial Act motion trial would proceed if the
government had a superseding indictment ready; defendant has no right to
have a trial in or jurors summoned from a particular division of the
district; claim that allowing one scientist to testify regarding DNA tests
conducted by another scientist violated defendant's Sixth Amendment
rights rejected; hearsay objection to the evidence was properly rejected.
