U.S. Court of Appeals Case No: 07-2181
U.S. District Court for the District of Minnesota - St. Paul
[PUBLISHED] [Gruender, Author, with Bye and Beam, Circuit Judges]
Criminal Case - conviction. District court did not abuse its discretion
in excluding cross-examination testimony that would have elicited
inadmissible hearsay testimony. Although defendant claimed statement
was offered for limited purpose of showing the investigation was not
thoroughly conducted, statement reveals investigation was not thorough
only if the statement were true and thus was offered for the truth of the
matter and constituted hearsay. Even if error, the error was harmless.
