Civil case - FOIA. The Vaughn index the Corps provided the district
court in connection with its claim that documents were exempt from
plaintiff's FOIA request was not inadequate on its face; while the Vaughn
index is sufficient to establish that some of the information plaintiff
requested is, in fact, exempted by the deliberative process privilege in
FOIA, the district court erred in failing to analyze the segregability of the
documents, and the court cannot conclude, at this time, that the privilege
applied to all 83 documents in their entirety; case remanded for a
segregability analysis.
