U.S. Court of Appeals Case No: 07-2341
U.S. District Court for the Western District of Missouri - Kansas City
[PUBLISHED] [Gruender, Author, with Riley and Shepherd, Circuit Judges]
Prisoner case - habeas. Bishop's properly filed motion to recall the
Missouri Court of Appeals' mandate tolled the AEDPA statute of
limitations; sentence became final for AEDPA purposes on the day the
Missouri Court of Appeals issued its mandate; while it appears the
Bishop has not met the requirements for his habeas petition to be
considered timely, he may be eligible for equitable tolling, and the case
is remanded to the district court for further proceedings on that issue.
