U.S. Court of Appeals Case No: 07-2356
and No: 07-3066
U.S. District Court for the Eastern District of Missouri - Hannibal
[PUBLISHED] [Melloy, Author, with Wollman and Hansen, Circuit Judges]
Civil case - civil rights. The district court did not err in determining
that plaintiff's evidence was insufficient to show that defendant Hollis's
action in subduing plaintiff with a Taser induced plaintiff's
rhabdomyolysis; Missouri's sudden onset doctrine did not apply in this
situation, where there were multiple possible causes and a complex and
uncertain chain of causation; award of attorneys' fees award must be
remanded for further consideration in light of the court's opinion.
