U.S. Court of Appeals Case No: 07-2411
U.S. District Court for the District of Minnesota - St. Paul
[PUBLISHED] [Smith, Author, with Bye and Colloton, Circuit Judges]
Criminal case - criminal law. District court did not err in finding
defendant had abandoned his motel room before the police made an
initial entry into the room; evidence seized during a second entry and
warrantless search was admissible; search of a separate room was not
tainted by the search of the abandoned room; court would not review
second search on a ground not raised in the trial court as defendant had
offered neither convincing arguments nor authority to support the
challenge.
