Criminal case - criminal law. Conviction for misdemeanor assault in
the third degree under Mo. Rev. Stat. 565.070 does not contain the
necessary elements of 18 U.S.C. Sec. 921(a)(33)(A)(ii), and the district
court erred in denying defendant's motion to dismiss the charge of
possession of a firearm after being convicted of a misdemeanor crime of
domestic violence.
