U.S. Court of Appeals Case No: 07-2447
U.S. District Court for the Northern District of Iowa - Cedar Rapids
[PUBLISHED] [Wollman, Author, with John R. Gibson and Shepherd,
Circuit Judges]
Criminal case - criminal law and sentencing. Affidavit provided in
support of search warrant established probable cause to believe defendant
had child pornography on his home computer; even if the state search
warrant was invalid, the evidence seized from defendant's home was
admissible under the independent source doctrine; district court did not
clearly err by enhancing defendant's offense level for distribution of child
pornography to a minor.
