Civil case - contracts. Parties' agreement concerning termination was
ambiguous and Swift's claim for breach of contract cannot be resolved as
a matter of law; neither party produced conclusive evidence that dictates
the acceptance of their interpretation of the provision, and the district
court erred in defendants' motion for summary judgment; district court
did not err in granting summary judgment for Swift on defendants'
counterclaim for breach of contract; nor did the court err in granting Swift
summary judgment on defendants' counterclaims under the Minnesota
Consumer Fraud Act.
