U.S. Court of Appeals Case No: 07-2544
U.S. District Court for the District of Minnesota - Minneapolis
[PUBLISHED] [Bye, Author, with Smith and Colloton, Circuit Judge]
Civil case - consumer law. Reasonable borrowers would have believed
they had given up their right of rescission when they signed closing forms
which required them to certify that the three-day rescission period
mandated by the Truth-in-Lending Act had passed on the same day the
transaction was consummated, and Rand's failure to clearly and
conspicuously disclose the Mouas' three-day right to rescind was a
violation of the Act which extended the rescission period to three years.
