U.S. Court of Appeals Case No: 07-2585
U.S. District Court for the Western District of Missouri - St. Joseph
[PUBLISHED] [Smith, Author, with Loken, Chief Judge, and Riley,
Circuit Judge]
Criminal case - criminal law and sentencing. Evidence used to support
revocation of supervised release was admissible because the Fourth
Amendment's exclusionary rule, absent showing of harassment, does not
apply at revocation hearings, and there was no evidence of harassment in
this case; revocation sentence was reasonable, and the district court gave
proper consideration to defendant's health and the BOP's ability to
provide adequate treatment for his condition; recent changes to
Guidelines Sec. 4A1.2(a)(2) and c did not apply to defendant.
