U.S. Court of Appeals Case No: 07-2593
and No: 07-2808
U.S. District Court for the Northern District of Iowa - Cedar Rapids
[PUBLISHED] [Arnold, Author, with Murphy and Benton, Circuit Judges]
Criminal case - Criminal law and sentencing. District court did not
clearly error in considering uncharged conduct in setting defendant
Gilbert's sentence as her possession of the handguns in question was part
of the same course of conduct as, and hence relevant conduct for the
offense of conviction; no error in imposing an enhancement based on the
fact that one of the weapons was stolen; refusal to grant a departure was
unreviewable; district court did not err in excluding certain statements as
hearsay as the corroborating circumstances did not clearly indicate the
trustworthiness of the statements; evidence was sufficient to support
defendant Cole's conviction for being a felon in possession of firearms;
defendant Cole's sentence was not unreasonable.
