U.S. Court of Appeals Case No: 07-2607
U.S. District Court for the Northern District of Iowa - Cedar Rapids
[PUBLISHED] [Benton, Author, with Arnold and Murphy, Circuit Judges]
Criminal case - criminal law and sentencing. Prior drug conviction was properly admitted under Rule 404(b) as the evidence was relevant; prosecutor did not engage in improper vouching for the government's witnesses; government gave defendant adequate notice under 21 U.S.C. Sec. 851 of its intention to seek an enhanced sentence; challenge to use of 2002 drug conviction at sentencing rejected, as the conviction qualified as prior conviction for a felony drug sentence and could be used to support the imposition of mandatory minimum life sentence.
