U.S. Court of Appeals Case No: 07-2618
U. S. District Court for the Northern District of Iowa - Dubuque
[PUBLISHED] [Riley, Author, with Loken, Chief Judge, and Smith,
Circuit Judge]
Criminal case - criminal law and sentencing. The district court did not
err in admitting other bad acts evidence under Rule 404 as the evidence
went to defendant's knowledge and intent to commit the charged drug
offenses and it was similar in kind and sufficiently close in time; district
court did not err in finding defendant was a career offender and did not
err in considering his Iowa conviction for operating a vehicle while under
the influence a crime of violence.
