U.S. Court of Appeals Case No: 07-2631
U.S. District Court for the Northern District of Iowa, Waterloo
[PUBLISHED] [Gruender, Author, with Riley and Shepherd, Circuit Judges]
Criminal case - Criminal law and sentencing. Evidence was sufficient
to support convictions for drug and firearm conspiracies and firearm
possession; district court explicitly stated it understood its authority
to grant a departure and its refusal to do so is unreviewable on appeal;
district court did not apply a presumption of reasonableness to the
advisory guidelines range and imposed a reasonable sentence; district
court did not abuse its discretion by failing to consider the disparity
between crack and cocaine sentences; jury determined the offenses
involved crack cocaine, and defendant's argument that the court
improperly found that fact in violation of his rights under Apprendi is
rejected.
