U.S. Court of Appeals Case No: 07-2641
U.S. District Court for the Western District of Missouri - Kansas City
[PUBLISHED] [Wollman, Author, with Hansen and Melloy, Circuit Judges]
Criminal case - criminal law. Considering the facts of the case and the likelihood of prejudice, the district court did not err in admitting evidence of defendant's flight attempt; no error in admitting evidence that a handgun was found abandoned at the scene of defendant's arrest as it went to the issue of his possession of another weapon; out-of-court statements of co-defendants were properly admitted as the district court substantially complied with the procedures set out in U.S. v. Bell, 573 F.2d 1040 (8th Cir. 1978), and defendant was not prejudiced by the court's failure to make specific Bell findings; any error in admitting a controlled- buy informant's statement to investigating officer was harmless; district court did not abuse its discretion in granting a one-week continuance to allow the government to procure a witness's attendance.
