U.S. Court of Appeals Case No: 07-2705
U.S. District Court for the District of Minnesota - Minneapolis
[PUBLISHED] [Colloton, Author, with Bye and Smith, Circuit Judges]
Civil case - Civil rights. For the court's previous opinion in the case,
see Flowers v. City of Minneapolis, 478 F.3d 869 (8th Cir. 2007). Plaintiff
failed to show that he was targeted for police surveillance and harassment
on the basis of his race; while a police officer's investigative decisions
remain subject to traditional class-based equal protection analysis, they
may be not be attacked in a class-of-one equal protection claim; plaintiff
failed to present sufficient evidence that he was harassed because of his
decision to plead not guilty in a previous criminal matter; because
plaintiff cannot establish that an individual officer violated the
Constitution, the district court correctly dismissed his claim against the
City for allegedly maintaining an unconstitutional custom or policy; grant
of summary judgment in favor of defendant officer on plaintiff's
defamation claim affirmed.
