Civil case - Securities. District court did not err in when it dismissed
plaintiffs' amended consolidated complaint for failure to state a claim
because plaintiffs failed to state with particularity facts giving rise
to a strong inference that the defendants acted with the state of mind
required by the Private Securities Litigation Reform Act; although the
district court's opinion was issued before Tellabs, Inc. V. Makor Issues
& Rights 127 S.Ct. 2499 (2007), the district court's opinion was
consistent with Tellabs and controlling Eighth Circuit decisions and is
affirmed.
