U.S. Court of Appeals Case No: 07-2859
Board of Immigration Appeals
[PUBLISHED] [Smith, Author, with Wollman and Gruender, Circuit Judges]
Petition for review - Immigration. The complaint petitioner filed in
federal district court attacked the Immigration Judge's order of removal,
and vested this court with the sole and exclusive means for judicial
review; court lacked jurisdiction over the matter because it was not filed
within the time limits for filing a petition for review of an order of
removal; petitioner's inability to seek habeas review of the removal order
does not violate the Suspension Clause of the Constitution as the REAL
ID Act is an adequate substitute for habeas review.
