U.S. Court of Appeals Case No: 07-2920
U.S. District Court for the Eastern District of Missouri - Cape Girardeau
[PUBLISHED] [Benton, Author, with Arnold and Murphy, Circuit Judges]
Criminal case - criminal law and sentencing. Police officers had a
reasonable suspicion that defendant was carrying a gun, and they were
justified in drawing their weapons and frisking defendant when he
disobeyed their commands and tried to walk away; in a separate incident
officers knew there was an arrest warrant for defendant, and the officers
had reasonable suspicion to stop his vehicle in order to determine if he
was, in fact, the driver of the car; no error in admitting evidence of prior
convictions; no error in admitting DNA evidence to tie defendant to a bag
of drugs; evidence was sufficient to support drug, firearms and child
pornography convictions; Jury instruction on possession of a firearm
while trafficking, while erroneous, did not entitle defendant to plain
error relief; mandatory life sentence did not constitute cruel and
unusual punishment in violation of the Eighth Amendment.
