U.S. Court of Appeals Case No: 07-2968
U.S. District Court for the Eastern District of Missouri - St. Louis
[PUBLISHED] [Murphy, Author, with Colloton and Shepherd, Circuit Judges]
Civil case - conversion. Bankruptcy court did not err in finding plaintiff has the senior security interest in debtor's collateral under the terms of the debtor's reorganization plan; given that plaintiff had the senior interest, the bank cannot prevail on its argument that its seizure and sale of the collateral was permitted by its security interest; trial evidence supported submission of a punitive damages instruction on plaintiff's conversion claim; under Missouri law separate punitive damages instructions are required for each tort; amount of punitive damages award for conversion did not violate bank's due process rights; punitive damage award for trespass reduced by 90%; jury instructions on interest were not erroneous. Judge Colloton concurring in part and dissenting in part (on the question of reducing the punitive damages award for trespass).
