Railroad's arguments that plaintiff's personal injury claims were preempted by the Federal Railroad Safety Act was foreclosed by recent amendments to the Act and this court's decision in Lundeen v. Canadian Pacific Railway, 532 F.3d 682 (8th Cir. 2008); as a result, the district court did not err in remanding the case to state court.
