   settlement agreement without conducting an evidentiary hearing;
   defendants failed to make a timely request for such a hearing and their
   pleadings failed to suggest that additional evidence would be useful;
   further, based on the parties' earlier representations to the court, there
   was no substantial factual dispute over the terms of the agreement. Judge
