The district court erred in reversing the Commissioner's denial of Passmore's disability claim on the ground that the his due process rights were violated when the ALJ denied his subpoena request; due process does not afford social security claimants an absolute right to cross-examine, and the ALJ did not abuse his discretion in denying Passmore's subpoena request; case remanded to the district court to determine if the denial of benefits was supported by substantial evidence.
