U.S. Court of Appeals Case No: 07-3099
U.S. District Court for the Eastern District of Missouri - St. Louis
[PUBLISHED] [Smith, Author, with Loken, Chief Judge, and Wollman,
Circuit Judge]
Civil case - civil rights. Based on evident racial tension in the school,
Farmington High School administrators could reasonably ban the wearing
of the Confederate flag to prevent anticipated future disruptions, and the
district court did not err in granting summary judgment for the school on
plaintiffs' claims that the school violated their First Amendment rights
when it sent them home after they appeared for school wearing the
Confederate flag; school's actions did not violate the Missouri Strip
Search Statute, Mo. Rev. Stat. Sec. 167.166.7.
