U.S. Court of Appeals Case No: 07-3156
U.S. District Court for the Western District of Missouri - Kansas City
[PUBLISHED] [Chief Judge Loken, Author, with Beam and Bye,
Circuit Judges]
Civil Case - diversity. Class action claims arising out of H&R Block's
Refund Anticipation Loan program are excluded from "prior acts"
coverage under the professional liability "claims made" insurance policy
because other class actions asserting similar claims were filed prior to the
policy periods and H&R Block had knowledge of the wrongful acts and a
reasonable basis to foresee that additional class action claims might be
brought.
