U.S. Court of Appeals Case No: 07-3184
and No: 07-3359
District of Nebraska - Omaha
[PUBLISHED] [Bowman, Author, with Riley and Hansen, Circuit Judges]
Criminal case - criminal law. The district court did not err in excluding
some of defendants' documentary evidence in this tax evasion
prosecution; to the extent any of the documents were relevant, they were
cumulative; challenges to jury instructions rejected, as the instructions
defendants requested were not accurate statements of the applicable law;
district court's comments during trial did not deprive defendant's of a fair
trial, and were, for the most part, comments simply related to the orderly
administration of the proceedings; district court's questions to certain
witnesses were needed to clarify testimony and draw out the facts
necessary for a clear presentation of the issues.
