District court erred in granting defendant's motion for summary judgment on plaintiff's claims the defendant violated his rights under the ADA by terminating him and refusing to rehire him based on his disability; plaintiff produced enough evidence to create a jury issue on the question of whether defendant's stated reasons for his discharge were a pretext for discrimination based on disability; further, plaintiff produced sufficient evidence to create a jury issue as to whether two denial of his applications for re-employment were based on pretexts.
