dismissing claims against defendant Little, a correctional officer at the
Crow Agency detention facility, as he was acting outside of the scope of
his employment when he attempted to arrest Johnson for intoxication on
a public highway; district court did not abuse its discretion in failing to
hold a hearing on the government's 12(b)(1) motion; discovery order
affirmed.
