U.S. Court of Appeals Case No: 07-3428
Board of Immigration Appeals
[PUBLISHED] [Melloy, Author, with Riley and Bright, Circuit Judges]
Petition for Review - Immigration. The BIA abused its discretion in
denying petitioner's motion to reopen; case remanded to the BIA to
consider petitioner's evidence of changed country conditions as it relates
to his claim of future persecution based on his political opinions, whether
real or imputed, and, whether, in light of his particular circumstance, his
evidence establishes a material change in country conditions such that
reopening is warranted.
