U.S. Court of Appeals Case No: 07-3456
U.S. District Court for the Eastern District of Arkansas - Pine Bluff
[PUBLISHED] [Murphy, Author, with Wollman and Smith, Circuit Judges]
Civil case - employment discrimination. District court did not err in
dismissing plaintiff's claim that she was discriminated against on the
basis of her gender as she failed to show that similarly situated males
were treated differently; assuming plaintiff established prima facie cases
of gender and age discrimination, she failed to show that the stated reason
for her discharge, modifying purchasing documents contrary to a
management decision, was a pretext; district court did not err in granting
employer summary judgment on plaintiff's equal pay claim as she failed
to show that she was paid differently for equal work; district court did not
err in dismissing plaintiff's state law claim for defamation as her
supervisor had a qualified privilege for the statement under Arkansas law.
