U.S. Court of Appeals Case No: 07-3645
U.S. District Court for the Southern District of Iowa - Davenport
[PUBLISHED] [Smith, Author, with Bowman and Gruender, Circuit Judges]
Criminal case - Sentencing. District court did not err in applying an
enhancements for role in the offense (Guidelines Sec.3B1.1); while the
court erred in not making an independent assessment of the record to
determine whether defendant committed perjury, there was no error in
imposing an enhancement for obstruction of justice (Guidelines Sec.
3C1.1) as the record left no doubt that defendant's testimony was not
the result of confusion, mistake or faulty memory.
