U.S. Court of Appeals Case No: 07-3673
U.S. District Court for the Eastern District of Missouri - St. Louis
[PUBLISHED] [Smith, Author, with Gruender, Circuit Judge, and
   Rosenbaum, District Judge]
Civil case - civil rights. District court erred in finding plaintiff's complaint failed to state a claim; even though the defendant Land Clearance for Redevelopment Authority was acting outside of its authority when it purported to deny plaintiffs' application for a sign permit, the plaintiffs have sufficiently alleged that the Authority acted under color of state law in purporting to deny the permit.
