U.S. Court of Appeals Case No: 07-3699
U.S. District Court for the Western District of Missouri - Kansas City
[PUBLISHED] [Riley, Author, with Bowman and Colloton, Circuit Judges]
Civil case - torts. When the trial court discovered that the joinder of
new defendants requested in plaintiff's motion to amend his complaint
would defeat diversity jurisdiction, the court had discretionary authority
to reconsider and reverse its previous joinder decision; district court did
not abuse its discretion in denying the motion to amend as the absence of
the additional defendants did not impair the court's ability to grant
complete relief and neither additional defendant claimed an interest in the
action; even if the defendants were necessary parties, they were not
indispensable parties under Fed. R. Civ. P. 19(b); court did not err in
denying plaintiff's motion to remand the case to state court; defendants'
summary judgment on plaintiff's claims for intentional infliction of
emotional distress is affirmed. Judge Colloton, concurring in part and
concurring in the judgment.
