U.S. Court of Appeals Case No: 07-3720
U.S. District Court for the District of South Dakota
[PUBLISHED] [Bowman, Author, with Melloy and Smith, Circuit Judges]
Criminal Case - conviction and sentence. Sufficient facts to support conspiracy conviction were presented and thus the district court did not err in denying motion for judgment of acquittal. Although defendant played a minor role, sufficient testimony confirmed she knew of the conspiracy and intentionally joined it, and was an actual participant. The district court did not abuse its discretion in denying motion for new trial.
